Who is responsible for mold inspection, tenant or landlord?« Back to Previous Page

The AC in my bedroom in Jumeirah Village Circle has been making us all stuffy and I just found black spots along the bottom of the wall behind the wardrobe. Our landlord says it's just dust and that we need to clean the AC filters more often, but the smell is really strong. Who is actually responsible for getting a proper mold inspection done here, the tenant or the landlord?

Based on Dubai's rental laws and the specific conditions you've described, the responsibility for addressing this issue lies squarely with the landlord. The presence of black spots and a persistent strong smell are classic indicators of a significant mold problem, not merely dust.
Under the Dubai Rental Law (Law No. 26 of 2007), landlords are legally obligated to provide a habitable property and are responsible for all major maintenance related to the structure and essential services, including the air conditioning system and the building envelope. The mold growth behind the wardrobe is a structural issue, likely caused by a combination of the humid Dubai climate and a fault in the AC system, such as a clogged condensate drain line or poor insulation causing excessive condensation. This is not a result of simple tenant upkeep like filter cleaning. Your landlord's assertion that it is "just dust" is a common but incorrect dismissal. A professional inspection is non-negotiable here. The inspection will identify the specific mold species (e.g., the potentially hazardous Stachybotrys, or "black mold") and, crucially, the root moisture source. Attempting to clean it without fixing the underlying cause is ineffective and can exacerbate spore dispersal. For a definitive resolution, you must insist on a certified mold inspection.
