Is AC mold treatment the landlord's or tenant's responsibility?« Back to Previous Page

Our bedroom AC unit in our Jumeirah Village Triangle apartment has been leaking a bit for the last couple of months, and now I’m seeing a patch of black, speckled mold spreading on the wall behind the curtain. We’ve been waking up with stuffy noses and I’m really worried about my toddler’s health. Is getting this treated the landlord's responsibility, or is it on me as the tenant to fix the AC leak and clean the mold?

Based on UAE rental law, specifically Law No. (26) of 2007, the responsibility for maintenance falls into two categories. Structural and fundamental maintenance of the property, including the fixed air conditioning system and the building envelope, is the legal obligation of the landlord. This includes repairing the AC unit itself to stop the leak, which is the source of the moisture.

However, as the tenant, you are responsible for maintaining the cleanliness and hygiene of the rented unit. The resulting mold growth on the wall surface, while a consequence of the landlord's maintenance issue, is often considered a tenant's cleaning responsibility once the source of the moisture has been fixed.

In your case in Jumeirah Village Triangle, the primary issue is the leaking AC unit. You must formally notify your landlord or property management company in writing to repair the AC and stop the water intrusion immediately. This is their responsibility. The persistent humidity and condensation from our year-round AC use in Dubai's climate create a perfect environment for toxic black mold (like Stachybotrys) to flourish rapidly, which aligns with the health symptoms you're describing.

Do not attempt to clean this yourself. Disturbing the mold can aerosolize harmful mycotoxins, especially dangerous for a toddler. Once the landlord has repaired the leak, you must engage a professional remediation company like Saniservice. We perform a detailed inspection, contain the area, safely remove the contaminated materials, and apply specialized antimicrobial treatments to ensure the environment is safe for your family.
